By using the site, you agree to these Terms of Use, including our Privacy Policy and Cookies Policy and any additional terms and conditions that may apply to specific sections of the site or from us. You represent that you are at least age 18 and have the power and authority to agree to these Terms of Use. If you are using the site on behalf of another person, you represent that you are authorized to accept these Terms of Use on that person’s behalf and agree to these Terms of Use on behalf of that person. If you are using the site on behalf of an organization or entity, you represent that you are authorized to accept these Terms of Use on that organization or entity’s behalf and agree to these Terms of Use on behalf of that organization or entity. Artificial Intelligence

We use artificial intelligence (AI) to analyze uploaded resumes and assessment responses, generate personalized career pathway reports (as seen in the Navigator Report), and match user inputs to viable career suggestions using natural language models and classification algorithms.  We employ third-party sources including ChatGPT in the provision of these services and functions.  We do not use AI to make automated decisions with legal or financial implications, but only to offer guided recommendations. Any action or decision that may impact an individual’s privacy rights will be subject to human oversight and intervention as needed.  You agree to comply with applicable laws and regulations in your use of our AI features and not to use such features in a manner that infringes, misappropriates, or otherwise violates any third party’s rights.  YOU AGREE AND ACKNOWLEDGE THAT OUTPUTS OF OUR AI SERVICES HAVE NOT BEEN REVIEWED FOR ACCURACY, BIAS, EXPLAINABILITY, HALLUCINATION, OR INTELECTUAL-PROPERTY-RIGHTS CLEARANCE. WE MAKE NO REPRESENTATION, WARRANTY, OR GUARANTEE AS TO THE ACCURACY, RELIABILITY, OR ERROR-FREE PERFORMANCE OF OUR AI SERVICES, INCLUDING (WITHOUT LIMITATION) WHETHER OUR OUTPUTS MAY INFRINGE, MISAPPROPRIATE, OR VIOLATE ANY THIRD-PARTY INTELLECTUAL PROPERTY RIGHTS.

 

Intellectual Property

You acknowledge that you have no right to copy, attempt to copy or retain or attempt to retain an electronic copy of the NxCourse Intellectual Property, or any portion thereof, including the proprietary platform and the questionnaires, quizzes, tests, assessments, and other forms. Subject to these Terms of Use, we grant you a non-exclusive, non-transferable, limited right to access, use and view the site and the information provided in connection with the same, including, without limitation, all tests, assessments, quizzes, questionnaires, forms, reports, text, files, designs, graphics, drawings, illustrations, images, photographs, video clips, music and sounds, and/or other materials and all trademarks, service marks and trade names used by us in providing the site and the selection and arrangements thereof (collectively, the “NxCourse Content”). Except as expressly provided herein, no license to use or reproduce the NxCourse Content is given to you and all intellectual property rights therein are expressly reserved. Systematic retrieval of data or other NxCourse Content from or in connection with the site to create or compile, directly or indirectly, a collection, compilation, database or directory without express prior written permission from us is prohibited. Except as expressly provided in these Terms of Use, you will not permit or authorize or permit any third party to (a) copy the NxCourse Intellectual Property or the NxCourse Content; (b) modify, translate or otherwise create derivative works of the NxCourse Intellectual Property or the NxCourse Content; (c) disassemble, decompile or reverse-engineer the NxCourse Intellectual Property or the NxCourse Content; (d) publish, re-sell, or otherwise make available to any third party, the NxCourse Intellectual Property or the NxCourse Content; or (e) export or re-export the NxCourse Intellectual Property or the NxCourse Content in violation of any United States export law or regulation; or (f) use the NxCourse Intellectual Property or the NxCourse Content in any manner that could damage, disable, overburden, or impair such property or interfere with any other party’s use and enjoyment of such property. You acknowledge that all rights granted to you herein regarding the NxCourse Intellectual Property or the NxCourse Content are your rights alone and, except as expressly stated herein below, you shall have no right to sell, distribute, dispose of, or transfer any right or license to use the NxCourse Intellectual Property or the NxCourse Content to any third party. The mark NxCourse™ and all logos incorporating the mark, and certain of the other names, marks, and logos on or in connection with the site are trademarks and service marks owned or controlled by us. All goodwill generated from use of our marks will inure to our exclusive benefit. You may not, nor may you allow others to, directly or indirectly sell, license, rent, reproduce, modify or attempt to modify, or create derivative works from the site content in any way or reproduce or publicly display, perform, transmit or distribute or otherwise use the site content for any public or commercial purpose. You may not systematically retrieve data or other site content from our site to create or compile, directly or indirectly, a collection, compilation, database or directory without our prior written consent. You do not have the right to delete or alter any copyright, trademark or other proprietary rights notices from copies of materials from the site. No right, title or interest in or to the site or any content on the site is transferred to you, and all rights not expressly granted are reserved to us.

If you maintain an online account with us, we may verify your identity for a request through the normal account authentication process, meaning you will need to sign on with your username and password.

Non-Discrimination

We will not discriminate against you for the exercise of your rights under the UCPA.  We will not deny you goods or services, charge a different rate or price to you, or supply a different level or quality of goods to you.  We may, however, offer different prices, rates, levels of service or quality of goods those who share their Personal Information in the event you opt out of targeted based advertising or if the offer is related to your voluntary participation in our loyalty program.  To the extent certain of our services require your Personal Information and you choose not to provide the necessary Personal Information, you may not be able to use those services.

 

Consumer Request Procedure

In order to submit a Consumer Request, please submit your name, customer or account email address, and a description of your request with sufficient detail that allows us to properly understand, evaluate, and respond to it, at:

If you maintain an online account with us, we may verify your identity for a request through the normal account authentication process, meaning you will need to sign on with your username and password.

 

We will respond to the request within 45 days of its receipt.  If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.  The information may be delivered to through your account, or, if you do not maintain an account with us, by mail or electronically at your option, and if provided electronically, the information will be in a portable and, to the extent technically feasible, readily useable format that allows you to transmit the information to another entity without hindrance.

 

We are not required to respond to requests to provide Personal Information to you more than twice in any 12-month period.  Any disclosers we provide will only cover the 12-month period preceding the receipt of the request.  The response we provide will also explain the reasons we cannot comply a request, if applicable.

 

We do not charge a fee to process or respond to your request unless it is excessive, repetitive, or manifestly unfounded.  If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

 

Enforcement
The UCPA does not contain a private right of action.  However, it does provide for the Utah Attorney General to enforce its provisions.  If you feel as though a violation of the UCPA has occurred, please contact the Utah Attorney General.
